1. Agreement
By creating an account or using the Burki services (“Service”) you agree to these Terms. If you're using Burki on behalf of an organization, you represent that you have authority to bind that organization. If you don't agree, don't use the Service.
2. The Service
Burki is a multi-tenant voice AI platform that orchestrates telephony, speech-to-text, large language models, text-to-speech, and related infrastructure. We provide APIs, dashboards, and managed runtime to operate voice agents.
3. Accounts
You're responsible for the accuracy of your account information, the security of your credentials, and all activity under your account. Notify us immediately of any unauthorized access at [email protected].
4. Acceptable use
You agree not to use Burki to:
- Make calls that violate the TCPA, CAN-SPAM, GDPR, or any other applicable communications or data protection law.
- Run robocall or unsolicited outbound campaigns to recipients who have not consented or who appear on a Do-Not-Call list.
- Impersonate humans in a way that misleads recipients about whether they're speaking with AI.
- Generate, distribute, or facilitate fraud, scams, harassment, hate speech, or abuse.
- Reverse-engineer, scrape, or attempt to disrupt the Service.
- Use the Service to compete directly by reselling raw inference under another brand without a written reseller agreement.
We may suspend or terminate accounts that violate these rules without notice.
5. Billing
- Pricing is published at burki.dev/pricing and may change with 30 days' notice for annual contracts.
- The platform fee is $0.03/min plus pass-through costs from the providers you select.
- BYO mode: you supply provider keys; we charge only the platform fee.
- Invoices are issued by Stripe. Failed payments incur a 7-day grace period before suspension.
- Refunds: prorated for unused prepaid minutes if you cancel within 30 days of purchase. No refunds on consumed usage.
6. Your data, your IP
You retain ownership of all content, prompts, transcripts, recordings, and configurations you upload or generate (“Customer Data”). You grant Burki a limited license to process Customer Data solely to operate the Service for you. We do not train models on your data without explicit opt-in (see Privacy Policy).
7. Service levels
We target 99.9% monthly uptime for the dashboard and control-plane APIs. Voice/data-plane availability also depends on the upstream providers you select. Plan-specific SLA terms are in your order form or DPA. Outages caused by provider failures, force majeure, or your own configuration are not counted toward our SLA.
8. Disclaimers
The Service is provided “as is”. We disclaim all implied warranties to the maximum extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement. Voice AI output may be inaccurate; you are responsible for human review where stakes are high (medical, legal, financial).
9. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising under these Terms is limited to the greater of (a) $100 USD or (b) the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages.
10. Termination
Either party can terminate at any time. We may terminate immediately for material breach, non-payment, or violation of Section 4. On termination you can export your data for 30 days, after which we delete it (subject to legal retention).
11. Changes
We may update these Terms with 30 days' notice for material changes. Continued use after the effective date is acceptance.
12. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Disputes are resolved in the courts of New Castle County, Delaware, except where applicable consumer protection law requires otherwise.
